Terms and Conditions

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state or province of residence, or that you are the age of majority in your country, state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our Services for:

  • any illegal purpose
  • unauthorized purpose
  • for violating any laws in your jurisdiction (including but not limited to copyright laws).

You as Customer confirms that the provision of the service by our company will not constitute a breach by you or by us of any sanction, embargo, or export control laws imposed by any country, state, province, government or other competent authority which apply to you or to us. The Customer confirms that he observes and is responsible for compliance with all applicable laws and regulations (including but not limited to foreign trade regulations and any sanction or prohibition imposed by any country, state, international governmental organization or other relevant authority) and shall not maintain any connections with persons or organizations against which restrictive measures in the fight against terrorism or any other foreign trade related sanctions have been imposed.

TopShipping will not provide services to persons and/or entities identified on:

  • The U.S. Department of Commerce Denied Persons List, Entity List of proliferation concern, or Unverified List; or
  • The U.S. State Department List of Statutorily Debarred Parties ; or
  • The List of Specially Designated Nationals (SDN) maintained by the U.S. Department of the Treasury’s Office of Foreign Assets Control. TopShipping also will not provide services to any person or entity that is directly or indirectly involved in the financing, commission or support of terrorist activities or in the development or production of nuclear, chemical, biological weapons or in missile technology programs as specified in the U.S. Export Administration Regulations (15 C.F.R. part 744).

TopShipping will not directly or indirectly, participate in any way in any transaction involving any commodity, software or technology (hereinafter collectively referred to as “item”) exported or to be exported from the United States that is subject to the International Traffic in Arms Regulations (ITAR) or that would require an export license under the Export Administration Regulations (EAR). 

TopShipping takes every precaution and makes every effort to fully comply with all laws and regulations governing international trade, including the Foreign Trade Regulations (FTR), relying on the information provided by the Member and the U.S. seller.

TopShipping will not accept “postage due” mail and/or COD packages, items or parcels on behalf of Customer unless Customer has previously arranged and prepaid such acceptance with TopShipping.  At its sole

discretion, TopShipping may refuse to accept “postage due” mail and/or COD packages, items or parcels on behalf of Customer under any circumstances.

Customer further acknowledges

that TopShipping may return to sender or discard any mail that is received at such mailing address but is addressed to a name not previously registered with TopShipping or is addressed to a name that has not completed the requirements set forth by TopShipping to verify the identity of such name, or is shipped by USPS from the vendor to a name for which TopShipping has not received a properly executed USPS Form 1583 and two forms of identification.

TopShipping takes every precaution and makes every effort to fully comply with all laws and regulations governing international trade, including the Federal Trade Statistics Regulations (FTSR).

TopShipping reserves the right to open and inspect all items delivered in your name without notice to you. The following list is a non-exclusive sampling of items that are either restricted, cannot be shipped or, depending on your destination country, may either require an import license, additional documentation and/or cause problems and delays during the customs review of your shipment:

  • Combustible/flammable items (paints, oils, lighters)
  • Any type of pressurized can (hair spray, shaving cream, spray cans of any type)
  • Hazardous materials (matches, chemicals, explosives)
  • Firearms, weaponry and their parts: military, police and tactical equipment of any kind, including guns, gun replicas, gun accessories, gun components (magazines, clips and rail systems), ammunition, knives, swords, compound bows, crossbows, discharge weapons such as shock batons or stun guns, tooling for guns or gun parts, optical scopes, laser sights, night sights, night vision goggles, handcuffs and other restraints, surveillance equipment.
  • Agricultural products such as tobacco, plants and seeds.
  • Coffee
  • Perishable foods
  • Animals and products made with animal skin (furs)
  • Alcohol
  • Cash, currency, money orders, cashiers’ checks, bank drafts, bearer bonds and collectible stamps and coins. Jewelry and precious stones are (a) restricted to some countries and (b) can only be insured up to $500 maximum and any shipments of jewelry in excess of $500 carriage limit is uninsured and Member assumes all risk of loss above such limit
  • Lottery tickets and gambling devices
  • Prescription and/or veterinary medication
  • Pornography
  • Lock picking devices
  • Government IDs and licenses, or items that claim to be, or that look similar to, government identification documents. This includes uniforms and badges or patches designed to look like official government issue.

In addition to these lists of Prohibited or Restricted Commodities, the customer cannot ship items that are listed on the Country-Specific list of Prohibited or Restricted Commodities listed on shipping carrier’s sites:

  • UPS Facts and Regulations & Guide to Shipping Dangerous Goods
  • DHL Facts and Regulations & Guide to Shipping Dangerous Goods
  • USPS Facts and Regulations & Guide to Shipping Dangerous Goods

For more up-to-date information on country-specific facts and regulations, the customer must refer to the local customs authority in his country.

Customers can pre-pay Duties and Taxes that are charged by customs office in the destination country. If you choose to pre-pay Duties and Taxes, you may avoid customs delays.

If you do not choose to pre-pay Duties and Taxes, you will be responsible for Duties, Taxes, and any other related charges when your package arrives in your country.

If Customer refuses to accept packages or parcels from TopShipping mailed or forwarded to Customer pursuant to this agreement, TopShipping may return the mail or package to the original sender and charge the customer for any return postage and all other fees and expenses reasonably incurred by TopShipping in connection with such returns. Upon the request of TopShipping, the Customer must sign for or otherwise acknowledge its acceptance of all packages and parcels sent to Customer by TopShipping.

TopShipping includes order descriptions and values with the customer shipment(s), to facilitate custom clearance of packages when they arrive to the destination country. The customer is however responsible for paying all custom clearance costs including duties, taxes or any other related charges, and of providing detailed commercial invoices, if requested, to the customs office in his country, to clear his package(s) through customs for delivery.

The customer will be held liable for return shipping (if applicable), duties and taxes (if incurred), and for all associated fees when any of the following circumstances occur:

  • They refuse delivery of your parcel for any reason.
  • The carrier makes unsuccessful attempts to deliver his parcel to his address because he was not at home and/or did not pay duties and taxes.
  • They provide an invalid or incorrect address.
  • Their parcel is returned by customs because your merchandise is restricted from import into his country.
  • They refuse to pay duties and taxes.
  • If the customer fails to clear the items from Customs.
  • They want to return an Assisted Purchase that they have already received for whatever reason. (We send the customer a copy of the order confirmation when the Assisted Purchase is placed, and they are responsible for notifying us of any inconsistencies before we receive and forward the Assisted Purchase to them)

If any of the above occurs, the package(s) will be abandoned and the customer will be billed for any additional fees. Absolutely no refunds will be issued.

All Packages are shipped on a limited liability basis. In no event shall TopShipping be liable to anyone for any indirect, punitive, special, exemplary, incidental, consequential or other damages of any type or kind. In no event shall TopShipping be liable to anyone for any direct damages of any type or kind (including lost profits) from performance of TopShipping or its shipping carriers.

Dimensional weight may apply on bulky, lightweight packages. If the dimensional weight exceeds the actual weight, then the dimensional weight will be used as the billable weight for the shipment. For your convenience, the actual weight, dimensional weight and dimensions for each box will be visible on your account when your package arrives at our warehouse. The Shipping calculator shows results for the discounted shipping rates available to the selected destination. All shipping rates are shown in US dollars. Packages are forwarded by the shipping carriers that are available on the Shipping calculator, however if a certain shipping carrier does not offer a certain shipping method such as Priority or Economy service to the area where the customer is located, we will automatically use an alternate shipping method offered by the same carrier.

If the shipping carrier charges a remote area surcharge to deliver packages to the area where the customer is located, this surcharge will be requested from the customer before we ship his packages to him. If the customer does not pay the remote area surcharge within 5 days, we will automatically ship his packages to his address with another shipping carrier that does not charge a remote area surcharge to deliver to the area where the customer is located.

If the shipping carrier does not deliver to the area where the customer is located, we will automatically use another shipping carrier that can deliver packages to the area where the customer is located.

The shipping rates displayed on TopShipping and on any of its pages, or provided as quote to any business or individual, are confidential and intended solely for the addressee(s) and may be legally privileged or prohibited from disclosure. If you are not the named addressee, you are on notice of its status and may not use copy or disclose this information to any other person. To do so could be a breach of confidence and unlawful.

TopShipping stores packages free of charge for a period of 180 days from the date of delivery from merchants to TopShipping warehouse. The maximum free storage time for each package is 180 days since the date of its delivery to your suite from the merchants. After 180 days of free storage, the goods will be deemed abandoned and thus may be disposed of without incurring any liability to the customer or TopShipping or any other party whatsoever.

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. TopShipping reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

Customer will enter a confidential password and receive a US address with his own unit number when registering for a new account with TopShipping. Customer shall maintain the security and confidentiality of the password. Customer is responsible for all directions, orders, notifications, expenses incurred or other actions that may occur through use of the Customer’s account. Customer must immediately alert TopShipping of any fraudulent, unauthorized, illegal or suspicious use of the Service or any other breach of security or unauthorized or illegal activity that is reasonably suspected by Customer.

To protect our customer’s accounts against fraud; the change of the country on the forwarding address is not allowed. The forwarding address can only be modified to another address within the same country that the customer selected during his registration on TopShipping. If the forwarding country was selected in error during registration, the correction must be requested by sending a message to our customer service from the same email address used for the registration on TopShipping.

Supporting documentation including a utility bill and two Government issued picture identification cards will be requested to verify the new forwarding address. Forwarding to other Freight Forwarding companies inside or outside the United States is absolutely not permitted.

TopShipping warehouse is a private and secure facility, and it is not open to the public. Pickups by individuals or unauthorized shipping carriers are not allowed. (Our warehouse is not publicly accessible, so you can’t come by yourself or send a friend or an unauthorized shipping carrier to pick up your packages.)

Most of the activity at the Site involves the viewing of materials, which are made accessible to everyone so there is no need for it to be secure. Other areas of the Site require the use of passwords, usernames and may have other security features. You are responsible to keep your usernames and passwords confidential. You should promptly notify TopShipping if you become aware of unauthorized use of your usernames or passwords or use of services or materials available from this Site. The use of your usernames or passwords by you, or by any person with or without your knowledge or consent, in connection with a TopShipping transaction, binds you legally and makes you responsible to the same extent and effect as if you had given signed, written instructions to us, unless you have previously notified us that the confidentiality of your usernames or passwords has been compromised.

This site and/or application is provided by TopShipping on an ‘as is’ and ‘as available’ basis. TopShipping makes no representations or warranties of any kind, express or implied, as to the operation of this site and/or application or the information, content, materials or products included on this site.
